Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Operator Base mobile application and related services (collectively, the "Service") provided by DIGITAL WARRIORS LLC ("Operator Base," "we," "us," or "our").

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Description of Service

Operator Base is a gamified platform designed for AI agency operators. The Service includes daily missions, an AI co-pilot, learning courses, community features, direct messaging, and productivity tools. Features may change as we develop and improve the platform.

2. Account Registration

To use the Service, you must create an account with a valid email address. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.

You must be at least 13 years old to create an account. By creating an account, you represent that you meet this age requirement.

3. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
• Harass, threaten, abuse, or harm other users or any third party.
• Post or transmit content that is defamatory, obscene, fraudulent, or otherwise objectionable.
• Distribute spam, chain letters, or unsolicited commercial communications through the Service.
• Attempt to reverse engineer, decompile, or disassemble any part of the Service.
• Interfere with or disrupt the integrity or performance of the Service.
• Use automated means (bots, scrapers, crawlers) to access or interact with the Service without our written permission.
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity.

4. User-Generated Content

You retain ownership of content you create and share through the Service ("User Content"). By posting User Content, you grant Operator Base a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your User Content solely in connection with operating and providing the Service.

You are solely responsible for your User Content. We do not endorse or guarantee the accuracy of any User Content. We reserve the right to remove User Content that violates these Terms or is otherwise objectionable, at our sole discretion.

5. Intellectual Property

The Service, including its design, code, graphics, logos, and all other proprietary materials, is owned by DIGITAL WARRIORS LLC and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on any part of the Service without our prior written consent.

6. Payment and Subscriptions

Certain features of the Service may require a paid subscription. Payments are processed by Stripe. By subscribing, you agree to the following:

• Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date.
• You may cancel your subscription at any time through the app or by contacting support@operatorbase.com. Cancellation takes effect at the end of the current billing period.
• Refunds are handled in accordance with the refund policies of the Apple App Store and Google Play Store for purchases made through those platforms.
• We reserve the right to change subscription pricing with 30 days' notice. Continued use after a price change constitutes acceptance of the new price.

7. Termination

We may suspend or terminate your account at any time if we reasonably believe you have violated these Terms or if your use of the Service poses a risk to other users or our systems.

You may delete your account at any time from Settings > Account > Delete Account, or by emailing support@operatorbase.com. Upon account deletion, your personal data will be removed in accordance with our Privacy Policy.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DIGITAL WARRIORS LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING OUT OF YOUR USE OF THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

10. Indemnification

You agree to indemnify, defend, and hold harmless DIGITAL WARRIORS LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or related to your use of the Service, your User Content, or your violation of these Terms.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Miami-Dade County, Florida.

12. Dispute Resolution

Before filing any legal claim, you agree to attempt to resolve the dispute informally by contacting us at support@operatorbase.com. We will attempt to resolve the dispute within 30 days. If the dispute is not resolved informally, either party may pursue binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules.

You agree that any arbitration will be conducted on an individual basis, not as a class, consolidated, or representative action.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes at least 30 days in advance by email or through an in-app notification. Your continued use of the Service after the effective date of the revised Terms constitutes acceptance of the changes.

14. App Store Terms

If you download the app from the Apple App Store or Google Play Store, you also agree to their respective terms of service. In the event of a conflict between these Terms and the app store terms, the app store terms shall govern solely with respect to your use of the app store.
